General T&Cs: Users agree to be bound by the Magic Eden Terms of Service and Privacy Policy and those terms provided by third party partners (collectively, the “Terms”).
Third Party Events and Perks: Participation in any campaigns, quests, promotions or other events (collectively, the “Events”) to qualify for certain rewards, perks or benefits (collectively, the “Perks”) is strictly optional. The Events are organized, run and distributed by Magic Eden’s third party partners directly and accordingly, Magic Eden is not responsible for the distribution of Perks. Magic Eden may share certain data pursuant to the Privacy Policy so that the relevant third party may organize Events and distribute Perks. Each third party may provide additional terms and conditions applicable to the participation in the Event and distribution of the relevant Perk.
Eligibility: Magic Eden and and its third party partners reserve the right to withhold Perks from, and revoke the eligibility of any user or wallet address whom they reasonably suspect is engaging in dishonest or abusive conduct, including but not limited to engaging in money-laundering, wash trades, false trading, self-dealing, trades that display any attributes of market manipulation, or engaging in any other illegal, fraudulent or harmful activity. Determinations of eligibility will be at the sole discretion of Magic Eden and its third party partners.
Magic Eden Specific Terms for Events and Perks:
Magic Eden and its partners reserve the right to interpret, modify, suspend, cancel or terminate any Events at any time for any reason without prior notice. In the event of conflict, Magic Eden’s interpretation shall be final.
Magic Eden expressly disclaims any and all responsibility and liability for any technical, pictorial, typographical, editorial or other error or omission in any Event or these terms and conditions.
Perks and any related Events: (i) are not an offer, recommendation or solicitation of an offer to buy, sell or otherwise deal in any digital asset; and (ii) are not intended to provide any advice or recommendation (regardless of investment, trading accounting, legal, tax or otherwise).
Perks and any related Events are not intended for distribution to, or access by, any person in a jurisdiction where such distribution or access would be contrary to applicable laws or regulations. Persons accessing and/or participating in any Events are required to inform themselves about and observe such restrictions.
The value of digital assets can and do fluctuate greatly from time to time. The value at the time a participant qualifies to receive any Perks may not be equal to the value at the time of distribution to the participant.
Participants are responsible for all applicable taxes, fees, costs and expenses relating to the receipt and use of any Perks.
To the extent that Magic Eden is held liable for any losses as a result of participation in an Event and distribution of the relevant Perk, Section 16 (Limitation of Liability) of Magic Eden’s Terms of Service applies.
